KC man charged with murder in the shooting of a man who asked him not to smoke PCP
A 41-year-old Kansas City man is charged with second degree murder for allegedly shooting and killing a man who had asked him not to spoke PCP in his apartment complex.
Elijah A. Marshall was charged in Jackson County Circuit Court on Thursday with armed criminal action and second degree murder in the June 1 killing of Ivory Harris, according to a news release from the Jackson County Prosecutor’s Office.
According to charging documents, Marshall had been spending time at the apartment complex in the 2100 block of East 13th Street where Harris was killed to visit another person.
About two weeks prior to the shooting, Harris allegedly asked Marshall not to smoke PCP in the apartment complex, Harris’ son told police. During that confrontation, prosecutors allege, Harris pulled his shirt up and motioned as if he had a gun telling Marshall, “I’m just letting you know.”
The day before the shooting, prosecutors allege, another witness heard Marshall telling others in the apartment complex that he was going to get his gun and shoot someone.
The next day, Harris’ son told police, Marshall returned to the scene. Harris’ son said he saw Harris and Marshall outside before hearing gunshots.
He said he ran outside and and asked Marshall if he killed his father.
According to court records, Marshall responded that Harris “shouldn’t have pulled a gun on me” before running off.
Police identified Marshall after receiving an anonymous tip that someone who had been coming around the complex argued with Harris regularly and a disturbance was called on that person three weeks before the homicide.
Both witnesses identified Marshall in a photo lineup, prosecutors allege.
After he was arrested, Marshall denied the shooting and said that he left the apartment complex after an interaction with Harris, court records said.
Marshall is being held in the Jackson County Detention Center at $250,000 bond.
