Two KC brothers charged with murder after man is fatally shot outside apartments

Two brothers have each been charged with second-degree murder after a man was fatally shot outside East Hills Village Apartments earlier this week, the Jackson County Prosecutor’s Office said in a news release.

Malik Sherman, 23, and Micheal Sherman, 27, are also facing charges of second-degree kidnapping and armed criminal action in connection to the shooting death of Andre Tolan.

The two men allegedly shot and killed the victim because they thought they were being set up to be robbed.

Kansas City police were called to the apartments in the 7600 block of Monroe Avenue just after 6 p.m. Thursday. Outside one of the buildings, officers found Tolan, 22, lying on the ground with gunshot wounds to the head and abdomen. The victim also had multiple abrasions, according to charging documents filed Friday.

Three men were detained for questioning, including the Sherman brothers.

Surveillance video from the apartments appeared to show the victim arriving in a car and being escorted away by two men who looked similar to the brothers, court records state. Minutes later, the victim is shown on the video descending the landing of the breezeway and falling onto the ground.

Two witnesses inside one of the apartments reported hearing the gunfire to police. The witnesses said the brothers then entered the apartment. One of them, Micheal Sherman, was seen with a gun, the witnesses said.

Police later searched the apartment and found inside a bedroom a .40 caliber handgun and a .556 caliber rifle, which contained live ammunition with an “LC19” head stamp.

Two .40 caliber shell casings and two casings with “LC19” on the head stamp were found near Tolan’s body, court records state.

In interviews with police, the brothers said they were in a car with Tolan and drove to the area of 68th Street for a drug deal involving marijuana. The brothers stated that a male with a gun approached them as they arrived. Micheal Sherman said he believed the male fired at their car at one point. Believing they were going to be robbed, Micheal Sherman told police he fired back toward the male, and Malik Sherman then drove the three to the apartments.

Micheal Sherman allegedly admitted to shooting Tolan, stating that he believed Tolan was involved in setting up the potential robbery.

Court records state Micheal Sherman “considered just beating up the victim, but considered potential retaliation if they let him go.”

Malik Sherman also told police he shot at Tolan with a rifle after his brother started shooting, court records noted.

Charges against the brothers were filed Friday. The prosecutor’s office said it has requested bonds to be set at $300,000.

Online court records on the cases, including information to reach the brothers’ attorneys, were not yet available Friday night
