Parents sue over death of toddler at Lenexa day care

The parents of a 16-month-old boy who died last year at a Lenexa home day care have filed a wrongful death suit against the day care operator.

Jace Boxberger died last April 28 after a piece of his clothing got snagged on a fireplace and he was strangled, according to the suit filed Monday in Johnson County District Court.

The suit alleges that Jace and a 14-month-old child were in the living room unattended while day care operator Cynthia L. Burrows was in the adjoining kitchen using a laptop computer.

"Defendant was unable to see Jace or the other child from her location," the suit alleges.

When Burrows discovered Jace, he was not breathing. She told her son to call 911 and attempted CPR on the child, according to the suit.

After first responders arrived, they continued CPR and took Jace to a hospital where he was pronounced dead.

The suit alleges that at some point after the incident, Burrows destroyed or tried to destroy evidence that she was using the laptop at the time of the incident.
