Man was ‘scared’ before fatally shooting two men on Truman Road: court documents

A Kansas City man faces a voluntary manslaughter charge after a double-shooting at a Kansas City convenience store, according to a Jackson County court document.

Emmanuel Hernandez faces one count each of voluntary manslaughter and armed criminal action.

Kansas City Police Department officers responded to a convenience store at 2200 E. Truman Road around 1:15 p.m. Sunday to reports of a shooting, according to court documents.

There, they found Taylor Garrett, 32, and Byron Garrett, 35, suffering from gunshot wounds, according to court documents. Both men were declared dead at the scene.

Hernandez was taken into custody on the scene, according to court documents. Spent shell casings at the scene matched a handgun with an empty magazine in his waistband.

A clerk at the store told investigators that he observed one of the victims talking to Hernandez, according to court documents. The victim slapped Hernandez, before Hernandez pulled out a gun and began shooting.

In an interview with officers, Hernandez said he stopped at a convenience store to get gas, according to court documents. The man said as he walked to the front door, he was “repeatedly struck on his head and face” by one of the victims, leaving him feeling as if “he was going to black out.”

Surveillance cameras corroborated Hernandez’s story, according to court documents. Video then showed Hernandez running back to his vehicle before holding both of his hands up.

The three men then walked into the business, according to court documents. As Hernandez walked into the store, one of the victims began talking to him before abruptly turning around and hitting Hernandez.

Hernandez then pulled out his handgun, telling police “he was scared,” according to court documents. As he began shooting, the two victims ran down an aisle of the store before falling, seemingly struck by gunfire.

Hernandez continued to shoot both victims after they were on the ground and struck one victim in the head with the gun, according to court documents.

After he shot the men, Hernandez told investigators he called 911, according to court documents.

Officers observed injuries to Hernandez’s face, and said the man complained about having a headache and a knot on his neck, according to court documents. He was transferred to a local hospital for treatment.

Hernandez is being held at the Jackson County Detention Center with no bond, according to the jail’s inmate listing. He is set to appear for a bond review hearing on July 29, according to court documents.
