Update: The victim in this case, 34-year-old Donald J. Hundley of Kansas City, died Sept. 29, police said.

A driver who crashed his vehicle and seriously injured a motorcyclist Sunday in Clay County was charged with second-degree assault, according to officials.

Jason Kissick, 49, of Smithville could face more charges as an investigation into the crash continues, said Sarah Boyd, a spokeswoman for the Clay County Sheriff’s Office, in a news release.

Deputies responded to the incident around 7:40 p.m. Litton Way near DD Highway and near Smithville Lake, Boyd said. At the scene, they found a Chevrolet Cruze that struck a 34-year-old man on a Harley Davidson motorcycle.

The motorcyclist remains in critical condition in a hospital. He was not wearing a helmet at the time of the crash, police said.

The driver of the Chevrolet stayed at the scene and was under investigation for driving while intoxicated.
