Second KCK man charged in Westport shooting that left 1 dead and 4 injured
Jackson County prosecutors have charged a second man in connection to a shooting in Westport in late February that killed one person and wounded four others.
Ernest P. Jones Jr., 23, of Kansas City, Kansas, faces unlawful use of a weapon and armed criminal action for the shooting that happened Feb. 29 at Mill Street near Westport Road, prosecutors said in a news release.
The shooting stemmed from an altercation that occurred earlier that evening during a birthday celebration inside of the Throwback nightclub.
Devin Harris, 17, was killed in the shooting that also left three other men and a woman with gunshot wounds. Prosecutors previously charged Devon L. Carter, 25, of Kansas City, Kansas, for his role in the fatal shooting.
According to court records, Jones was involved in a second argument that took place outside of the nightclub. A witness told investigators that a woman who appeared to be intoxicated walked across the street in front of their car. The argument happened after the driver of the car had to abruptly stop to avoid hitting the intoxicated woman.
A witness said she later saw someone in a white Acura driven by Jones, firing gunshots at a group on Mill Street, just north of Westport Road near a parking garage. That car followed a white Chevrolet Tahoe whose occupants had also opened fire at the group, according to court records.
The license on the Acura came back to belonging to Jones, prosecutors allege.
Police recovered 95 shell casings in the area of the shooting. About 40 of them matched shell casings found later in the parked SUV, court records stated.
Homicide detectives obtained surveillance video that confirmed occupants of the Tahoe had fired guns from the vehicle, prosecutors allege. The video also showed that after the SUV parked near 39th and Main streets, two other vehicles pulled into the parking lot, and several persons got out of the Tahoe and into those vehicles, carrying undisclosed items with them.
An officer on the way to the shooting spotted a white Tahoe backed into a parking spot at the CVS Pharmacy. Several women stood around the vehicle.
The officer checked out the SUV and noticed spent shell casings inside and multiple bullets holes. No one was inside the vehicle, and the women said it belonged to a relative, according to court records.
Devon L. Carter, 25, was arrested after he walked up to officers and said he was the owner of the Tahoe. Carter, of Kansas City, Kansas, was later charged with unlawful use of a weapon and armed criminal action in connection to the shooting, prosecutors allege.
On March 10, police arrested Jones after he walked out of a house in the 300 block of Richmond Avenue in Kansas City, Kansas. Jones was walking toward a white Acura that had the same Kansas license plate that was seen at the Westport shooting, prosecutors allege.
Jones declined to speak to investigators. Detectives later spoke to the owner of the residence on Richmond Avenue, who said Jones did not live there. The owner gave investigators consent to search the residence. Inside one of the bedrooms, detectives found several .9mm handguns as well as a .45-caliber handgun.
Detectives had previously collected numerous .9mm and .45-caliber shell casings from the Feb. 29 shooting in Westport, according to court records.
In 2017, Jones was placed on three years probation after he pleaded guilty to unlawful use of a weapon, according to court records.
