Baby's death prompts lawsuit against Eudora day care operators

A wrongful death lawsuit was filed Thursday against the operators of a day care in Eudora, Kan., where a 9-month-old boy was allegedly fatally injured.

The parents of Oliver Ortiz filed the suit in Johnson County District Court against Gina Brunton and Morgan Eric Brunton, the operators of Sunshine Kids Group Daycare Home in Eudora in Douglas County.

Oliver died on Sept. 29, 2016.

An employee of the day care, Carrody Buchhorn, is facing a felony murder charge in Douglas County District Court.

Her trial is scheduled for July.

Thursday's lawsuit alleges that the home's operators were at least partially at fault because of negligence and carelessness.

The suit seeks an unspecified amount in damages.

The day care's license was suspended by state officials after Oliver died. The operators did not contest the suspension and voluntarily turned in the license, according to a spokesman for the Kansas Department of Health and Environment.
