Jackson County prosecutors on Tuesday charged a 20-year-old man in the Saturday shooting death of a woman outside a south Kansas City convenience store in the 7000 block of Longview Road.

Charles L. Austin is accused of second-degree murder in the death of 31-year-old Misty Marion.

A witness identified Austin as the man who confronted Marion and the witness that night. The witness said he and Marion were running away when he heard two gunshots. Marion was shot in the back, according to court documents.

Austin had been involved in an altercation earlier this year during which Marion allegedly stabbed him in the neck, according to court records. Although he admitted to being in the area of the shooting, Austin denied shooting anyone.

Austin, who also is charged with armed criminal action, is being held in lieu of a $250,000 bond.

According to court documents, Marion and the witness were in the parking lot of The Bay Water Park, adjacent to the convenience store, when the gunman first confronted them. Since January, there have been two other homicides just outside or near the park. All three killings occurred while the facility was closed.
