Disney worker filmed up teen’s dress, had hundreds of videos of others, Florida suit says

An employee at Disney’s Hollywood Studios had a history of filming under skirts and dresses at work before a 14-year-old caught him doing the same to her, according to a Florida lawsuit.

In addition to facing criminal charges of video voyeurism, 28-year-old Jorge Diazvega now also faces a civil lawsuit.

The complaint, filed March 21 in Orange County by the girl’s grandparent, names Disney as well as Diazvega, saying the company was negligent because it knew Diazvega had a habit of non-consensual filming.

A co-worker at Disney’s Animal Kingdom had previously reported Diazvega to a supervisor when she caught him recording her, Diazvega told deputies, according to the lawsuit and an arrest affidavit from the Orange County Sheriff’s Office.

Diazvega recounted the co-worker searched his work phone, but he had taken the video with a different device, so she didn’t find anything, deputies said. The teen’s family is accusing Disney of failing to “adequately investigate the incident or take action to terminate his employment.”

McClatchy News reached out to Disney for comment March 25 and did not immediately receive a response. Diazvega’s attorney declined to comment, citing the pending cases.

The 14-year-old Michigan girl was visiting the Orlando theme park March 30, 2023, with her grandmother and sister when they encountered Diazvega working the store in the section of the park devoted to Star Wars, according to court filings.

Diazvega approached the family and was showing them how to use a toy, while holding another toy under his arm, when he “intentionally” dropped the second toy, the complaint says.

As he bent down to pick it up, he stuck a phone camera lens under the 14-year-old’s dress, brushing her shoe and the dress, according to the lawsuit.

The girl noticed and started “hysterically crying and screaming,” then she had a panic attack in the bathroom, the complaint says.

Law enforcement didn’t identify Diazvega as a suspect that day, and he went to work the next day and recorded another woman without her knowing, deputies said. But someone witnessed the incident, and he was arrested, documents said.

When deputies interviewed him, Diazvega estimated he had taken about 600 upskirt videos over the last six years, according to the affidavit. Deputies said he called them “candid shots.”

He wrote an apology letter during his interview to the affected girls and women, which was included in the affidavit.

“To anyone that’s reading this, I want to apologize for taking candid shots. Really sorry. I know what I did was wrong and I do not mean to cause any harm. I have autism and the times I was doing it I didn’t know the consequences. I really hope everyone lives a better life than me and please forgive what I have done. I want to apologize to every one of you.”

He’s facing two video voyeurism charges in the March 30 and March 31, 2023, incidents, records show.

The teen’s family is seeking damages for negligent employment and retention, invasion of privacy and infliction of emotional distress, the lawsuit said.
