Husband had ‘successful’ vasectomy, then wife finds out she’s pregnant, lawsuit says
A Minnesota couple is suing a medical center, saying a failed vasectomy led to an unplanned pregnancy.
Megan and Steven Szlachtowski are suing Minnesota Urology P.A., according to a lawsuit filed in June 2023. A trial is set to begin Nov. 4, court records show.
“We do not typically comment on issues involving our patients,” Minnesota Urology said in an Oct. 31 statement to McClatchy News. “MNU wishes the Szlachtowskis the very best in their future life with their healthy son.”
The couple says they were given false information about a failed medical procedure.
On Dec. 27, 2018, Steven Szlachtowski underwent a vasectomy, according to a civil complaint. In May 2019, post-vasectomy testing was done and the results were shared with him, the lawsuit says.
A nurse working at the medical center falsely told Steven Szlachtowski that the vasectomy was “successful,” when in fact, the results said otherwise, according to court records.
The nurse told Steven Szlachtowski that results “were negative and that it was ’ok to discontinue contraceptives,’” court records said. However, the results were positive, the lawsuit said.
On March 23, 2023, Megan Szlachtowski found out she was 15 weeks pregnant, the lawsuit said.
The couple said the pregnancy was unplanned and would lead to Megan Szlachtowski suffering pain and discomfort, and acquiring medical expenses related to her fourth pregnancy.
The couple is asking for more than $50,000 in damages, saying the unexpected pregnancy led or will lead to future loss of earnings and employment benefits, as well as emotional distress.
