A gun malfunctioned when a man tried to shoot a marijuana dispensary worker during a robbery in Oregon, police said.

Police responded to the robbery at 4:38 p.m. July 23 at Top Shelf Medicine, the Bend Police Department said in a news release.

A 41-year-old identified as Russell Ian Boggess struck a female worker in the face and threatened her with his gun, police said.

Boggess then took a bag of marijuana from the store and tried to shoot the worker twice, but his handgun didn’t work, police said.

He was put into a headlock by other workers until police got to the scene, authorities said.

Police said Boggess injured the two people who held him.

He was arrested on multiple charges:

  • Attempted murder

  • First-degree Robbery

  • Unlawful use of a weapon

  • Two counts of fourth-degree assault

  • Second-degree assault

  • Harassment

  • Three counts of menacing

  • Interference with a 911 call

  • Felon in possession of firearm

Bend is in central Oregon, about a 130-mile drive east from Eugene.
