Grand jury indicts Independence man for taking photos of a nude woman

A Jackson County grand jury has indicted a 55-year-old man for invasion of privacy.

David S. Simoniello of Independence is accused of taking photos of a woman sleeping in the nude without the woman’s consent and sending them to a man he met through a Craiglist ad.

According to court records, the 50-year-old victim said Simoniello took six photographs of her with his cellphone on May 23, 2015, and placed sticky notes on her breasts and other parts of her body that said “69” and “sex with me.”

The flash on Simoniello’s cellphone woke her, the woman said. When she asked what Simoniello was doing, he said he was checking on her while she slept.

Simoniello created a Craiglist ad indicating that two of them were swingers, the woman told investigators. She said she didn’t engage in that type of activity. She also repeatedly declined when Simoniello asked her to engage in activities with another man.
