Prosecutors move to dismiss charges against KCI bomb-threat suspect

Federal prosecutors moved Thursday to dismiss charges against a former police officer who allegedly threatened local airport security screeners with a bomb on the 2011 anniversary of the 9/11 terrorist attacks.

Anthony Falco Jr., who suffers from schizophrenia, is unlikely to be “restored to competency” to stand trial, prosecutors noted in court paperwork.

Federal prison authorities have twice determined that Falco is not a danger to society based on extensive medical and mental evaluations. Authorities had hoped to have him committed to a mental institution, but that is not possible without a “dangerousness certificate” issued by the U.S. Bureau of Prisons.

With no way to resolve the case by trial, plea or civil commitment, prosecutors said they had no choice but to ask a judge to dismiss the indictment, prosecutors said.

Timothy Fernandez, a 41-year-old man police earlier identified as a person of interest in a recent KC homicide case, has been charged with murder but is not yet in custody, Jackson County prosecutors said.
