Man charged with murder in killing of CVS worker in North Kansas City: court docs
A Kansas City man has been charged with murder in the fatal shooting of a CVS employee in North Kansas City Thursday, according to the probable cause statement in the case.
Antonio Serrano, 29, was charged with first-degree murder, armed criminal action, and unlawful possession of a firearm in Clay County, a day after he allegedly shot eight times at a CVS employee who was behind the store’s checkout counter, killing him.
Serrano’s former partner, who he recently separated with, is a CVS employee currently living with the victim, identified as Rusty Donovan, 42, court records said. The partner was not in the store at the time of the shooting.
Serrano allegedly has a history of domestic violence with the partner, records said.
He also allegedly told police he confronted Donovan about a text message at the same store a week ago. North Kansas City police responded to the store due to Serrano’s alleged threats, according to court records.
At 3:04 p.m. Thursday, officers responded to the store at 1914 Swift Street where they found the employee, Rusty Donovan, face down behind the counter with multiple bullet holes in his back and no pulse. Serrano allegedly spontaneously told police he wasn’t going to hurt anyone else, according to the probable cause statement. He also argued with a witness and allegedly told them he would kill them, too.
Twenty rounds of Winchester .40 caliber bullets in a green cloth sack, a black gun holster, and an empty black .40 caliber magazine was found on Serrano when officer’s arrested him, according to court documents. Nine shell casings were collected at the scene.
Store surveillance video allegedly showed Serrano walk into the store at 3:03 p.m. and point a silver and black handgun at a female employee, according to the probable cause statement. Then, the video allegedly shows Serrano pointing the gun toward Donovan and shooting several times.
Serrano took the magazine out of the gun and walked away before returning moments later to allegedly continue shooting Donovan, who was crawling away with blood on his right shoulder. He then walked to stand over Donovan and allegedly shoot him in the head, according to court records.
After the shooting, Serrano walked around the store and told an employee to call 911 to turn himself in. He then removed the magazine from the handgun and placed the gun and magazine on the counter.
In an interview with detectives, Serrano allegedly told police he could have hurt more people but decided not to. Serrano allegedly said he drank eight bottles of beer throughout Thursday.
He allegedly told police he felt sorry for killing Donovan and did not know why he killed him. According to court records, Serrano also allegedly told detectives he’s in a gang, deserves life in prison, thought about running and could have shot officers if he wanted to.
Serrano has been arrested at least four times, the most recent for first degree assault last year, according to court records. He is also a convicted felon, having served 33 days in the Jackson County Detention Center for resisting arrest and fleeing police in November 2019 in Jackson County.
