Man charged with rape in JoCo. Victim was unable to give consent, court docs allege

A Warsaw, Mo., man has been charged with sexually assaulting a victim in Overland Park who was unable to consent because of drug or alcohol intoxication, according to court records.

Timothy Paul Coniglio, 26, is charged in Johnson County District Court with rape and aggravated criminal sodomy.

He is also charged with three counts of being a felon in possession of a firearm and possession of marijuana.

The alleged incident occurred Jan. 29 in Overland Park, court records say.

The charges allege that the victim, who was 22 or 23, was incapable of giving consent because of drug or alcohol intoxication.

Coniglio had a prior conviction for making a criminal threat and cannot legally possess a firearm. His prior conviction appears to have been in California, according to court records there.

Bond for Coniglio is set at $250,000. He made an initial court appearance Friday afternoon and is due back in court Oct. 4.
