Missouri third grader sexually abused second grader at YMCA program, lawsuit alleges
A Missouri elementary school student and his father filed a lawsuit against the YMCA of Greater Kansas City last week, alleging that the student was sexually abused by another student while participating in an after-school program organized by the YMCA.
The 8-year-old survivor, identified in court documents as A.N., was 7 years old and in second grade at the time of the alleged abuse in November 2023. Both A.N. and the alleged aggressor, a third grade boy, were enrolled in the YMCA’s before- and after-school care program at Greenwood Elementary School in Greenwood. Missouri, according to court documents.
The lawsuit alleges that YMCA program staff left A.N. and the alleged aggressor alone in the bathroom together on three separate occasions, during which the older student allegedly coerced A.N. to engage in sexual acts including sodomy.
The lawsuit alleges that another student, a first grade girl, had notified program staff on Nov. 16 that the alleged aggressor had previously made sexual comments toward her, asking her explicitly to go to the bathroom with him to engage in sexual acts.
A.N., his father and the family’s attorneys allege that the YMCA was negligent by failing to properly supervise the students at the Greenwood program, allowing the sexual abuse to occur more than once, according to court documents. The lawsuit further alleges that YMCA employees were not trained properly in how to provide safe childcare, particularly in relation to bathroom supervision policies.
The YMCA of Greater Kansas City declined to comment on the pending lawsuit. Attorneys for A.N. and his family also declined to comment.
A.N.’s family is demanding a jury trial and plans to seek at least $75,000 in damages, according to court records.
