Man injured after Hy-Vee gave him the wrong prescription: Court documents

A lawsuit filed by a Pleasant Hill man on Thursday claims a Hy-Vee pharmacy gave him the wrong medication.

The suit also names the store’s pharmacist, Kansas City Urology Care and plaintiff Robert Ladd’s doctor there, according to court documents.

On July 11, 2023, Ladd visited the Hy-Vee pharmacy in Lee’s Summit to pick up a prescription, according to a Jackson County court document.

After taking the medication he was given, Ladd became extremely tired, dizzy and lightheaded, according to court documents. He also experienced brain fog, slurred speech and problems finding words, according to the lawsuit.

The effects caused Ladd to “fall several times, causing bodily injury to his head and neck, for which extensive medical treatment and surgical intervention were required,” according to court documents.

Five days later, Ladd’s wife noticed that he had been given a different medication with a similar name as the one that had been prescribed, according to court documents. Side effects of the medication Ladd was given include “drowsiness, nausea, and decreased memory or concentration, suicidal behavior, seizures, mania and liver damage.”

The medication also increases serotonin, according to court documents. Ladd’s primary care physician diagnosed him with serotonin syndrome.

Ladd and his wife are seeking damages due to “aggravating circumstances,” according to court documents.
