A judge ordered a former Olathe high school teacher to serve 30 days in jail as part of her probation for having sex with a 16-year-old student.
Jeana Marie Fleming, 33, was sentenced Tuesday in Johnson County District Court, where she pleaded guilty in February to a charge of unlawful sexual relations.
District Judge Sara Welch sentenced Fleming to two years and eight months in prison but then followed plea negotiations and placed Fleming on probation for three years.
Welch added the 30-day jail sentence as a condition of probation. She gave Fleming until 5 p.m. Wednesday to turn herself in so she could make arrangements for the care of her two small children.
Fleming also will be required to register as a sex offender.
Fleming and the boy had sex in December 2014 while she taught in the Olathe school district’s alternative education program for high school students.
Prosecutors charged her under a Kansas law that makes it a crime for a teacher to have sex with a student at the same school, even if the student is above the age of consent, which is 16 in Kansas.
The boy told school officials last May that the one-time encounter occurred at Fleming’s apartment in Olathe.
When officials questioned Fleming, she admitted the allegation and resigned from her job.
As part of a plea agreement, Fleming was required to obtain a sex offender evaluation and follow any recommendations.
If Fleming violates any conditions of her probation, she could have to serve the prison sentence.
