A 26-year-old Ballwin, Missouri, man has been charged in connection with the crash that killed a 68-year-old Overland Park woman out walking before dawn last week, according to court documents.

The Johnson County District Attorney has charged Brigham P. Morgan with involuntary manslaughter and leaving the scene of a crash, both felonies, in the death of Janet Dam, according to the court documents.

The charges allege that Morgan “unlawfully, feloniously and recklessly” killed Dam and failed to immediately stop and remain at the scene of the crash that resulted in the death of a person, or to stop as close as possible and then return to the scene.

The crash happened about 3:30 a.m. Oct. 28 near the bend where Goddard Street intersects with Switzer Road, just north of West 95th Street, according to Overland Park police.

Morgan was headed east on Goddard when he allegedly struck a parked vehicle on the westbound side of the road. Morgan’s vehicle continued east and allegedly struck Dam as she walked west on the edge of the road, police said. Morgan’s vehicle then crashed into a tree, coming to a stop.

Dam was pronounced dead at the scene, and Morgan was taken to a hospital for treatment of injuries sustained in the crash.

Initially, police had difficulty identifying Dam because she had no identification with her at the time of the crash. Police asked for help identifying her, saying she was a local resident known to walk in that area every day around 4 a.m.

Court records show that the charges were filed Monday, and an arrest warrant was issued for Morgan. He was arrested and booked into the Johnson County jail Tuesday afternoon, where he is being held on a $25,000 bond, according to jail records.

Morgan made his first appearance Wednesday afternoon, where he waived the reading of the charges. A preliminary hearing was set for 10 a.m. Nov. 12.
