The American Civil Liberties Union alleges that Morgan County officials are violating people’s constitutional rights by confiscating mail sent to jail detainees.
The St. Louis-based ACLU of Eastern Missouri filed a federal lawsuit last week and asked a judge to certify the case as a class action. The ACLU also is seeking a preliminary injunction.
The five-page lawsuit says the main issue is that officials don’t inform the sender of confiscated mail or give them a chance to fight the decision.
The ACLU said the lawsuit was filed on behalf of an Oregon resident who has regularly sent letters, articles and books to a Morgan County Adult Detention Center detainee. A phone message The Associated Press left at the jail wasn’t immediately returned.
