Trial ordered in fatal shooting at Olathe home

An Olathe man will stand trial on charges that he fatally shot his friend in September, a judge ruled Thursday.

Robert Shaun Ward, 34, is charged with first-degree murder in the death of David Wayne Barry, 36, and with being a felon in possession of a firearm. Police found Barry dead in Ward’s garage at 516 E. Brier Drive on Sept. 18.

At a preliminary hearing in Johnson County District Court on Thursday, three men testified that they were hanging out and drinking with Ward and Barry in the garage that night. The five men started passing around a handgun that one of them had brought to the home, and then, two of the witnesses testified, Ward asked them to leave the garage just before Barry was shot.

The witnesses — Ward’s roommate David Anderson, Ward’s friend Chad Richards and Barry’s friend Logan Shore — did not agree Thursday whether Ward and Barry were arguing. But Olathe Police Detective Ed Drake said Ward told investigators that Barry had disrespected him.

Olathe Police Officer Brandon Hickel said he and several other officers found Ward after the shooting lying near a tree line about a half mile from his home. He had a case of beer, a handgun and several other personal items, Hickel said.
