Prosecutors are scheduled to get mental health records they subpoenaed for James Holmes after attorneys for the Colorado theater shooting defendant got Holmes’ sanity evaluation from the state mental hospital.

A hearing is scheduled Monday in Arapahoe County District Court in Centennial.

Holmes pleaded not guilty by reason of insanity to multiple charges of murder and attempted murder. He’s accused of killing 12 people and injuring 70 in a suburban Denver theater in July 2012.

Prosecutors are seeking the death penalty.
