DA: Officer-involved shooting in Olathe was justified

The Johnson County district attorney has determined that an Olathe police officer committed no criminal wrongdoing in the fatal shooting of a man last month.

Cody M. Kincheloe, 21, of Olathe, was killed January 18 inside a Dollar General store after he reportedly pulled a handgun on the officer.

The officer had been called to the area of Santa Fe Street and Clairborne Road on a report of a wrong-way driver.

Police said that the officer found the car in the parking lot of the store at 112 N. Clairborne Road, and when the officer went inside, Kincheloe confronted him and showed a handgun.

No one else was injured.

An investigative team from other Johnson County police agencies investigated the shooting. Based on that investigation, District Attorney Steve Howe said the officer’s use of force was justified under Kansas law.
