Man shot to death near grocery store reportedly had just stolen marijuana

A man shot to death near a grocery store parking lot Tuesday had just stolen marijuana from another man, according to court records filed Wednesday.

Jackson County prosecutors charged Marcus T. Kennedy, 44, of Kansas City, with second-degree murder and armed criminal action in the death of Donald Donato, 21, of Kansas City. Kennedy remained in jail Wednesday, with bond set at $200,000.

Court records gave this account of the 1:15 p.m. shooting on a sidewalk near the Price Chopper at 5800 Wilson Road:

Kennedy approached Donato’s girlfriend as she walked out of a nearby gas station and asked if she wanted to buy some “green,” a slang term for marijuana. She declined and told Donato what happened. Donato told her he wanted to see what the man was selling, so he approached Kennedy and asked to see the marijuana.

When Kennedy showed Donato a bag of marijuana, Donato reportedly grabbed it and ran. Kennedy allegedly shot Donato twice in the back, then tried to run home to the 300 block of Lawndale Avenue. A security guard caught Kennedy and detained him for police. Kennedy had bags of marijuana and 9 mm rounds in his pocket.

A witness saw Kennedy toss a handgun in a yard and pointed it out to police, who recovered a 9 mm handgun.

Kennedy told police he shot at Donato twice after Donato took his marijuana, according to the court records.
