An early morning, drunken excursion among four friends ended in death when a gun accidentally fired inside a crowded truck.
On Friday, 26-year-old Justin Driscoll of Leavenworth pleaded “no contest” to involuntary manslaughter for shooting his friend in the face.
Dick Mathis, 30, also of Leavenworth and the father of four, died.
According to the Leavenworth County prosecutor’s office, Driscoll was driving at 3 a.m. July 13 in Leavenworth as four men were packed into the extended cab of a truck on their way to go swimming. Mathis remarked that if he saw anyone with his “ex-old lady” he would shoot them.
Driscoll reached into the glove box to get a gun. As he was passing it to the back seat, it discharged, striking Mathis in the face.
“I look back, seeing him bleeding,” Driscoll wrote in a statement for police. “I drive as fast as I could to the hospital. I didn’t know the clip had been put back in the gun.”
Sentencing is scheduled for Jan. 17.
