Boy accused of killing his father in Shawnee will remain in jail

A 14-year-old boy accused of fatally shooting his father was ordered by a judge Friday to remain in custody.

Dalton Gay is charged in the juvenile division of Johnson County District Court with first-degree murder in the death of his father, 46-year-old Darren Gay.

Darren Gay was killed Tuesday afternoon outside a western Shawnee business where his mother and stepfather had taken him for a scheduled visitation with his father, according to Shawnee police.

At Friday’s court appearance, Dalton was described as a good student with no prior legal troubles. But based on the seriousness of the allegations and the use of a weapon, Assistant District Attorney Don Hymer asked that Dalton remain in juvenile detention.

His mother asked that he be released while the case is pending.

“He will be OK at home,” said Karen Lindsay. “I love him.”

But Magistrate Judge Michael Farley said that because of the nature of the charges, Dalton should not be released at this time. He scheduled another court hearing for July 16.

The boy’s mother and stepfather were accompanied by a number of family members and friends at Friday’s court hearing. When asked for a comment after the hearing, they said they wanted to speak with Dalton’s attorney before releasing a statement.

“We just need our privacy,” a spokesman for the group said. “We don’t want to do anything to jeopardize the case.”

Johnson County prosecutors have not said whether they will seek to have Dalton tried as an adult.
