A Riverside man who accidentally shot and killed another man during a tequila- and marijuana-fueled Super Bowl party has been sentenced to 15 years in prison.

Joshua W. Bailey, 34, pleaded guilty Wednesday in Platte County Circuit Court to involuntary manslaughter, being a felon in possession of a weapon, unlawfully discharging a firearm while intoxicated and armed criminal action.
Bailey served as host for the Feb. 3 party at his apartment in the 4800 block of Northwest Homestead Road, where he consumed at least four shots of tequila and smoked marijuana. Bailey accidentally shot and killed his friend Joshua Anderson, 22, of Riverside, while showing his guests a Jimenez 9 mm semi-automatic handgun.
Bailey told police that he emptied the gun, then put in an ammunition clip and hit the slide release to make the slide go forward. He got up from the couch and pulled the trigger.
A bullet struck Anderson in the back of the head. Bailey called 911, telling the dispatcher that he had shot his friend, said Platte County Prosecutor Eric Zahnd.
Bailey said he did not know there was a bullet in the chamber.
“I’m going to jail,” Bailey allegedly told the dispatcher.
Police found Bailey in the yard and Anderson inside on the floor, in a pool of blood. He died about two hours later.
Bailey told police he didn’t aim at Anderson, but the gun must have been pointed in that direction.
Zahnd said Bailey was not allowed to have a firearm because of a previous conviction for possessing a controlled substance in Jackson County.
Platte County Circuit Judge Owens Lee Hull Jr. sentenced Bailey to six years for involuntary manslaughter and six years for being a felon in possession of a weapon. Hull sentenced him to three years for unlawfully discharging a firearm while intoxicated and three years for armed criminal action. Hull ordered each of the sentences to run consecutively, with the exception of the sentence for discharging a firearm while intoxicated, Zahnd said.
