Dallas J. Bogard of Kansas City, North, still faces a first-degree assault charge in the Jan. 27 death of 2-year-old Quentin C. Oliver.
The boy suffered fatal injuries while in a residence in the 1300 block of Northeast 46th Terrace. Bogard told authorities that a bookcase fell on Quentin.
Bogard has a court hearing scheduled for June 4. Clay County Prosecutor Daniel White said his office will re-evaluate the criminal case.
According to court records, Bogard told authorities he heard a thud, went to the boy’s bedroom and found him lying beneath a fallen bookcase.
Quentin suffered a temporal skull fracture with swelling in the brain and upper spine, authorities said.
